Terms and conditions
This is a translation for your convenience. Only the German version is legally binding.
§ 1 Scope, provider
(1) These General Terms and Conditions (GTC) apply to all contracts for the purchase and reservation of motor vehicles concluded between Auto Vermittler Pro, [Address / Anschrift] ("we") and our customers via this website, by e-mail, by telephone or at our premises.
(2) Customers within the meaning of these GTC are both consumers (§ 13 BGB) and businesses (§ 14 BGB). Deviating terms of the customer only apply if we expressly agree to them in writing.
(3) The contract language is German. Translations of these GTC are for information only; the German version is authoritative.
§ 2 Vehicle listings and conclusion of contract
(1) The presentation of vehicles on our website is not a legally binding offer but a non-binding invitation to contact us. Prior sale remains reserved.
(2) Via the website the customer can send non-binding requests (e.g. reservation request, vehicle enquiry, call-back request). A request does not create a contract and is free of charge. Payments only become due after the purchase contract has been concluded (§ 4).
(3) The purchase contract is only concluded by a separate written purchase contract (binding order by the customer and our acceptance) — at our premises or by e-mail or post. We provide the customer with the contract text in text form.
(4) Vehicle descriptions are based on the documents and manufacturer information available to us. Mileage information corresponds to the odometer reading unless expressly stated otherwise. Equipment details, images and technical data serve as a description and do not constitute a guarantee.
§ 3 Reservation
(1) A binding reservation is made by concluding the purchase contract. Payment terms and due dates are agreed individually in the purchase contract. From the agreed time, the vehicle is held for the customer and is no longer offered to third parties.
(2) Payments made before handover are credited in full against the purchase price. The remaining purchase price is payable at the latest on handover or before delivery of the vehicle.
(3) If the customer does not make a payment agreed in the purchase contract on time, we may withdraw from the contract after setting a reasonable grace period. The statutory right of withdrawal of consumers (§ 7) remains unaffected.
§ 4 Prices and payment
(1) All prices are final prices in euros including VAT. For vehicles taxed under the standard scheme, the statutory VAT (currently 19 %) is included and shown on the invoice. For vehicles subject to the margin scheme under § 25a UStG, VAT is included in the price but cannot be shown separately; these vehicles are marked accordingly.
(2) Costs for transfer, delivery, registration or number plates are only included if expressly stated; they are agreed separately before the contract is concluded.
(3) Payment is made by bank transfer or via a payment link sent by us (credit card via Stripe or cryptocurrency via NOWPayments), where agreed.
§ 5 Handover, delivery, passing of risk
(1) After full payment of the purchase price, the vehicle is handed over at our premises or delivered to the agreed address, at the customer's choice. The customer can follow the transport status via delivery tracking.
(2) For consumers, the risk of accidental loss and accidental deterioration passes on handover of the vehicle to the customer. For businesses, the risk passes on handover to the carrier.
(3) The vehicle registration certificate (Part II) and the keys are handed over after full payment.
(4) Before handover, every vehicle undergoes a new main inspection (HU, “TÜV”) at an officially recognised testing organisation; the cost is included in the purchase price.
§ 6 Retention of title
The vehicle remains our property until the purchase price has been paid in full.
§ 7 Right of withdrawal for consumers
Consumers have a statutory right of withdrawal for distance contracts. Details are set out in our cancellation policy. Withdrawal can also be declared online using the "Withdraw from contract" function.
Voluntary return and exchange right: Independently of the statutory right of withdrawal, the customer may return the vehicle within 21 days of handover against a refund of the purchase price paid, or exchange it for another vehicle from our stock (any price difference is settled). The vehicle must be returned in the condition at handover, apart from normal use, with all keys, documents and accessories. Details: Guarantee & return.
§ 8 Liability for defects (warranty)
(1) The statutory rights in respect of defects apply unless otherwise provided below.
(2) Used vehicles sold to consumers: the limitation period for claims for defects is one year from handover of the vehicle, provided the consumer was specifically informed of this shortening before submitting their contractual declaration and it was expressly and separately agreed in the purchase contract (§ 476 (2) BGB). Without such a separate agreement, the statutory period of two years applies.
(3) Used vehicles sold to businesses are sold excluding liability for defects.
(4) The shortening or exclusion under paragraphs 2 and 3 does not apply to claims for damages for injury to life, body or health, to claims for grossly negligent or intentional breach of duty, to fraudulently concealed defects, or where we have given a guarantee as to quality.
(5) In addition, we grant a dealer guarantee on every vehicle for 1 year from handover. Its content and conditions are set out in the guarantee declaration the customer receives with the purchase contract. The guarantee is free of charge; the customer's statutory rights remain unaffected and are not restricted by the guarantee.
§ 9 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent of any guarantee given.
(2) In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the customer may regularly rely), our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
§ 10 Part-exchange and purchase of vehicles
Information provided by the customer in the "Sell your car" form is non-binding. A purchase contract only comes about through a separate agreement after inspection of the vehicle. We are not obliged to make an offer.
§ 11 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
§ 12 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is our registered office.
(3) Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
